Keep I-94 valid: The I-94, not the I-797 Approval Notice or H-1B visa stamp, determines the legally authorized period of stay in the U.S. H-1B employees must ensure that their I-94 remains valid throughout the duration of their employment with the university. Working and/ or remaining in the U.S. after the I-94 end date means the employee begins to accrue unlawful presence, which may have adverse effects on future immigration benefits.
Keep passport valid: H-1B employees are encouraged to have a valid passport throughout their duration of stay in the U.S. An expired passport itself does not invalidate H-1B status but may create complications. Passport expiration may result in a shorter I-94 validity period, delay adjudication of immigration benefits, and prolong international travel if a new visa stamp is needed while outside the US.
